Compliance requirements
The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The bidder must also confirm that taxes and social security contributions have been paid, or that the relevant information is electronically available to the contracting authority.
Qualification criteria and exclusion grounds
The tender must comply with the conditions set out in the procurement documents. The bidder must submit the participation application in Form 1 and the price offer in Form 4, and confirm that the prescribed pricing structure is followed. In the case of a joint tender, a duly authorised representative must be appointed and a power of attorney from the joint bidders must be attached. If the person signing the tender is not a person with representation rights in the register, a power of attorney must be submitted. The bidder must confirm that the offered products comply with MDR 2017/745 and bear the CE mark, and that equivalence has been explained and supporting evidence attached where necessary. The bidder must also prove the right to sell the products in the Republic of Estonia with confirmation from the manufacturer or an authorised supplier. The machine-readable notice did not include precise qualification or suitability requirements; these must be checked in the tender documents.
