Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, nor persons with representation rights, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, child labour, or any other exclusion grounds listed in the ESPD. If any exclusion ground applies, the ESPD or the tender documents may require a description of self-cleaning measures and supporting evidence. The exact exclusion grounds and any possible evidence requirements must be checked in the ESPD and the tender documents.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register or another similar register in its country of establishment. For an Estonian bidder, the contracting authority checks the registration itself through the registers; a bidder from another country must provide, on request, a document proving registration. The person submitting the bid must have the right to represent the bidder; if not, a power of attorney must be attached. In a joint bid, a power of attorney for the joint bidders and a confirmation of joint and several liability must be submitted. The bidder must submit Form 3 confirming compliance with the tender conditions and that the bid is compliant. Form 4 confirming the provision of maintenance and warranty service in Tallinn and Tartu or within 20 km of those cities must also be submitted. The bid must include the completed technical description and bid form for the offered vehicles, and state the one-month operating lease price, the vehicle price and the residual value at the end of the 60-month lease period. The machine-readable notice did not include precise qualification or compliance requirements; these must be checked in the tender documents.
