Compliance requirements
The bidder will be excluded if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The bidder must confirm that neither it nor the persons with representation, decision-making or control rights have been convicted for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal use of labour, human trafficking or other listed offences. The bidder must also have no tax, levy or environmental charge arrears, and the contract award must not breach international sanctions or sanctions imposed by the Government of the Republic of Estonia. If the bid is submitted with a foreign entity, documents proving the absence of exclusion grounds may also have to be submitted.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement procedure must be at least EUR 600,000 excluding VAT, with at least EUR 200,000 in each year. If the bidder relies on the capabilities of another entity or is a foreign company, the contracting authority may require extracts from annual reports or other evidence, as well as a written confirmation from the relied-on entity covering consent, absence of exclusion grounds, participation in contract performance and joint liability. The bidder must also prove at least one reference contract: within the last 36 months, a properly performed contract for the design of an overhead line at 110 kV or higher, under which a preliminary or detailed design was prepared for a 15 km overhead line and included the design of lattice towers together with type testing. The reference information must include the contract name or description, the client’s details and the contract period. If the bidder relies on another entity’s experience, a confirmation from that entity must also be provided. To meet the compliance requirements, the bidder must submit a duly completed price table, team CVs and, where applicable, a power of attorney or a joint bidders’ power of attorney and confirmation. The bidder must confirm that it has reviewed the tender conditions, has the necessary intellectual property and personal data processing rights, and that the offered equipment or goods comply with the technical requirements.
