Compliance requirements

The exclusion grounds include at least participation in a criminal organisation, corruption and fraud. The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies, procurists or other persons authorised to represent it have been finally convicted of these offences within the last five years, or that any applicable exclusion period is still in force. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not include other precise exclusion grounds; these must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must submit a bid that complies with the technical requirements in Annex 1 and provide the technical data sheet and/or user manual issued by the manufacturer so that the contracting authority can verify compliance of the set. All parts of the offered set must bear the CE marking and the bidder must provide declarations of conformity and, where applicable, conformity certificates or copies thereof proving compliance with Regulation (EU) 2017/745. The bidder must be the official representative of the offered device and must submit documents proving the representation right granted by the manufacturer or the manufacturer’s authorised representative; in case of sub-delegation, the corresponding additional documents must also be provided. Throughout the entire contract performance period, the bidder must employ or otherwise engage a service engineer or service technician who has received manufacturer training for repairing the endoscopes, endoscope handle and endoscope fixation device offered in this tender; a copy of the training certificate must be submitted with the bid. Warranty-period maintenance plans must also be submitted, showing the frequency of preventive maintenance, the work to be performed and the time required. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders together with a confirmation of joint and several liability must be submitted. The bid must be unconditional and comply with all conditions set out in the procurement documents.
