Compliance requirements
The contracting authority will exclude a bidder if any exclusion ground under Section 95(1) of the Public Procurement Act applies. The bidder must confirm that neither it nor the persons with representation, management or control rights have been convicted of corruption, fraud, offences related to a terrorist act or other terrorist activity, money laundering, illegal use of child labour or human trafficking. The bidder must also confirm that it has no tax debt or social security contribution debt and that entering into the contract does not breach an international sanction or a sanction of the Government of the Republic of Estonia. If the bid is submitted together with a foreign entity, documents proving the absence of exclusion grounds must also be provided for persons whom the contracting authority cannot verify from public data.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last completed financial year before the start date of the procurement procedure must be at least EUR 3,000,000 excluding VAT, including at least EUR 1,000,000 in each year. If the bidder is foreign or the data cannot be verified from public registers, extracts from annual accounts or other evidence must be submitted at the contracting authority’s request. The bidder must have properly performed at least one contract for construction works at a 110 kV or higher-voltage substation within the last 60 months, including design work; the contract value must be at least EUR 500,000 excluding VAT and at least EUR 500,000 must have been paid to the bidder under the contract. If needed, a client reference or other evidence must be provided. If the bidder relies on another entity’s capabilities, a signed confirmation from that entity, its consent, and an explanation of how it will participate in contract performance must be submitted. As compliance requirements, the bidder must also provide a power of attorney if the signatory is not the legal representative, a joint-bidder power of attorney and confirmation in the case of a joint bid, a bid guarantee of EUR 8,000, a completed price schedule, a team CV, four technical questionnaires, a financing schedule, and, where applicable, a list of authorised persons not visible in the commercial register. The machine-readable notice did not include precise requirements; these must be checked in the tender documents.
