Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1), points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been initiated against it, and that its business has not been suspended. It must also have no tax, fee or environmental charge arrears, and no tax or social security contribution arrears. In addition, the bidder must confirm that the average salary of its employees during the reference period was above 70% of the average salary for the same period in the relevant sector, and must provide an extract from the Tax and Customs Board or an equivalent certificate from a competent foreign authority. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. In a joint bid, the exclusion grounds are checked for each joint bidder.
Qualification criteria and exclusion grounds
The bidder must be registered in the Business Register under the activity area ‘Construction’ with the activity types of general construction, indoor climate systems, and internal or adjoining water supply or sewerage systems. When electrical works are performed, the bidder must also have a Business Register notification under the activity area ‘Electrical works’ for construction, including installation, of electrical installations. For a foreign bidder, the registration requirement does not apply, but equivalent competence must be proven. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT; in a joint bid, turnover may not be aggregated and the requirement must be met by at least one joint bidder on its own. The bidder must provide details and proof of at least one equivalent construction project: the project name, timing, value, confirmation that it involved erection, extension or full-building reconstruction as the main contractor, and that it included construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and the heating system. Acceptable proof is a reference to the building register’s notice of use or occupancy permit number, or a copy of the handover-acceptance act signed by the client and contractor. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a competent person; for each role, the bidder must provide the person’s name and the number of the professional or competence certificate. The project manager must have at least level 6 construction engineer qualification with specialization in building construction or level 6 construction manager qualification with specialization in general construction. The site manager must have at least level 5 construction foreman qualification with specialization in general construction works. The ventilation and heating systems specialist must have at least level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or level 6 construction manager qualification with specialization in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification with specialization in the construction of internal or adjoining water supply and sewerage systems. The person involved in electrical works must have at least a class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. For foreign specialists, equivalent competence is accepted. By submitting the tender, the bidder must confirm compliance with the tender documents, conditional tenders are not allowed, and where applicable it must provide equivalence evidence, a joint-bid power of attorney, a power of attorney for representation, and written consents from team members who are not employees of the bidder.
