Compliance requirements
The bidder must confirm that neither the bidder nor, where qualification relies on another entity, that other entity has any exclusion grounds under Section 95(1) of the Public Procurement Act. If the answer is no, the bidder must describe which exclusion grounds apply. In addition, entities whose place of residence or establishment is in the Russian Federation or the Republic of Belarus may not participate in the procurement; the same applies to any entity whose qualifications the bidder relies on.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must have been at least EUR 180,000. The bidder must submit Form 1 with the information needed to verify qualification. Within the last 60 months, the bidder must have properly performed at least two similar construction contracts: they must have been carried out as main contractor or contractor, concern a building or building complex with at least 250 m² of enclosed net floor area, and include erection, extension or full reconstruction of a building with installation of a new electrical system. For the contracts, the bidder must provide the partner details, object description, floor area, work description and contract period; for contracts awarded through public procurement, also the procurement reference number. The contracting authority may request a client confirmation letter. To submit the tender, the bidder must complete Forms 2, 3 and 4 and, where applicable, Form 8. The tender must incorporate all tender document requirements, state the price excluding VAT both in the eRHR worksheet and in Form 3, and be prepared so that trade secrets can be separated. The project manager must either hold the professional certificate “Civil Engineer, Level 6” with specialisation in building construction and the competence “management of construction activities”, or the certificate “Construction Manager, Level 6” with specialisation in general construction; the competence “construction management” is not equivalent, and initial education-based qualifications are not accepted. In addition, a high-voltage specialist must be included, with at least a Class B competence certificate or the professional certificate “Electrical Engineer, Level 6”. If a specialist’s certificate was issued outside Estonia, the bidder must submit both the document from the competent foreign authority and a document from the competent Estonian authority confirming equivalence to the required qualification. If a specialist is qualified in several responsibility areas, the same person may cover multiple roles. The bidder must also confirm compliance with the tender documents and, where necessary, provide evidence of equivalence.
