Compliance requirements

The bidder must confirm that neither the bidder nor members of its management, governing or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last 3 financial years must be at least EUR 220,000 per year. The bidder must submit at least 1 contract performed within the 36 months preceding the start of the procurement, the subject of which was the development and/or operational management of an intellectual property management software solution. The contract must cover patent portfolio management, licence agreement management, and support for disclosure and confidentiality processes, and the managed patent portfolio must include at least 50 active patents and/or patent applications. The bid must include a technical offer, a video demonstration or a link to it, and, where applicable, screen captures so that the buyer can verify compliance with the technical specification. If the signatory’s authority does not appear in the register, a power of attorney must be provided. In a joint bid, a power of attorney for the joint bidders and ESPD documents for all joint bidders must be submitted.
