Compliance requirements

The exclusion grounds include at least participation in a criminal organisation, corruption, fraud and the other mandatory exclusion grounds listed in the ESPD. The bidder must provide confirmations and, where relevant, evidence of self-cleaning measures to restore reliability. The machine-readable notice did not include all precise exclusion grounds; these must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder’s total annual turnover for each of the last three completed financial years must be at least EUR 100,000. If the bidder relies on the resources of another entity, the bidder and that entity must be jointly liable for proper performance of the contract and provide a joint commitment letter. To prove technical and professional ability, the bidder must have at least 2 properly performed landscaping construction projects completed within the 60 months before the start of the procurement, each with a size of at least 141 m2. For each contract, the bidder must provide a short description, performance period, size, client contact details and the procurement reference number, if available. The contracting authority may request confirmation from the client that the works were properly performed. The bid must comply with the procurement documents, conditional bids are not allowed, the bid must remain valid for at least 60 days, and the bid price must be submitted according to the structure set out in the cost schedule. If an equivalent solution is used, it must be explained and evidenced where necessary. The compliance conditions also require confirmation of the sanctions rule: the bidder must not involve subcontractors or suppliers worth more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, entities more than 50% owned by such persons/entities, or representatives of such persons/entities or persons acting on their instructions. In a joint bid, an authorised representative must be appointed and a joint bidder power of attorney must be attached. The cost schedule must be submitted as an Excel file. The bidder must also confirm that the bid does not contain trade secrets, or describe any trade secrets with justification.
