Compliance requirements
The bidder and its management body members must not have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing. The same applies to the other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The exclusion grounds stated in the contract notice and procurement documents must be confirmed by the bidder’s responses.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment; a service provider operating in Estonia must be registered in the Estonian commercial register. To provide the service, the bidder must hold an operating licence issued by the Ministry of Education and Research in accordance with the Early Childhood Education Act, and the licence number must be provided. The bidder must have staff who meet the qualification requirements laid down in the Early Childhood Education Act. For each person working directly with children, the bidder must provide the name, personal identification code and position, and the contracting authority may request documents proving the qualifications. The bid must comply with all tender documents, be unconditional, and be signed by the legal representative or accompanied by a signed power of attorney. The completed Annex 4 and Annex 5 must be submitted with the bid, and any trade secrets must be marked and justified.
