Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, nor persons with representation rights, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or offences related to the commission of a terrorist act or terrorist activity. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that it will not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Estonian Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must have a construction manager who meets at least the level of ‘Certified Civil Engineer, Level 7’ with specialisation in building construction and the competence of construction management. The contracting authority will verify the qualification in the Estonian Chamber of Engineers register. If the bidder relies on the capacities of another person, the other person’s ESPD must also be submitted, and where necessary the data must be provided by the person authorised to sign on behalf of that person. Within the last 36 months, the bidder must have completed at least 1 construction management contract similar to or related to the management of building construction, public square works, or road/street works, with a value of at least EUR 2,000,000. The work must have been completed by the start of the procurement procedure. The bid must comply with the procurement documents and, where relevant, equivalent solutions must be explained and supported by evidence. The bid price must be submitted in the required structure and also in the separate price table.
