Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds in § 95(1) points 1–5 of the Public Procurement Act apply. In plain terms, this covers convictions for organised crime, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or violating conditions for employing foreigners; child labour or human trafficking; tax, environmental charge or social security arrears; and situations where the contract would breach an international or Government of the Republic sanction. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment if that is required by the laws of that country. A bidder established in Estonia does not need to submit a copy of the register extract. The bidder and/or its subcontractor must have properly performed at least one contract similar to the subject of the tender within the last 60 months before the start of the procurement; the contract must have concerned building and/or room repair works. A list of the main contracts must be submitted on Form 2, including the contract name, short description, performance period and the other contracting party. The bidder must also have qualified responsible persons for the works. At least one responsible person must hold at least the professional qualification 'Water Supply and Sewerage Engineer, level 6', specialisation 'Building water supply and sewerage', or an equivalent or better qualification. Copies of documents proving competence must be submitted. Foreign bidders without Estonian-issued proof must submit copies of qualification and competence documents issued under the laws of their home country and a confirmation that they will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person. For a joint bid, a joint bidders’ power of attorney must be attached. The bid must be unconditional, must confirm acceptance of all tender documents, must follow the required price form structure, and must include any evidence of equivalence if the bidder relies on equivalent solutions.
