Compliance requirements
The bidder must not be subject to mandatory exclusion grounds, including convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; enabling the illegal employment of a foreign national; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears; or breaches of international sanctions or Government of the Republic sanctions. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached a previous public contract, or if it has provided false information about qualification or failed to submit required documents. The bidder must confirm these matters.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 100,000. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years. At least 6 months must have passed since the end of the last completed financial year by the bid submission date. The bidder must submit extracts from the reports for the last three completed financial years, or another proof if the data are publicly available in a register accessible to the contracting authority. In addition, the bid must include Form 1 price quotation table, Form 2 technical information, confirmation of at least a 24-month warranty, confirmation of compliance and equivalence, and the details of the authorised signatory and contact person; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must also confirm that it is not established in the Russian Federation or Belarus and that the offered goods and their components are not produced in or originating from the Russian Federation or Belarus.
