Compliance requirements
A bidder is excluded if the bidder or a member of its management body has a statutory exclusion ground, for example participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or financing of terrorism. Exclusion grounds also include labour-law violations, illegal use of child labour, human trafficking, tax, fee or environmental charge arrears, and being subject to an international sanction. The bidder must confirm that no exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must have performed at least 1 similar contract as the main contractor within the 60 months before the start of the procurement. A similar contract means street lighting construction works with at least 10 lighting points. Only works accepted by the client during that period count; the warranty period may still be running. The bidder must provide in the procurement passport the details of the completed contract: contract object, scope of works performed, contract period and the other contracting parties (for public procurements, reference numbers must be given). On the contracting authority's request, the successful bidder must also provide confirmation from the other contracting party that the contract was performed properly. The bid must be unconditional and comply with all tender document requirements. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also confirm that it does not use a subcontractor who would have to be replaced under Section 122(7) of the Public Procurement Act, and that the offered goods are not the object of an international sanction and do not originate from sanctioned areas.
