Compliance requirements

The bidder must not be subject to the mandatory exclusion grounds: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment or violating the conditions for the employment of a foreign national; illegal use of child labour or human trafficking; and tax, fee or environmental charge arrears, or arrears of tax and social security contributions. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous contract, or has submitted false information about qualification or failed to provide the required data and documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

During the 60 months before the start of the procurement, the bidder must have properly completed at least three contracts for similar electrical construction works, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance periods, details of the other contracting parties and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance unless it can obtain the information itself from public or its own databases without significant cost. The tender must comply with the procurement documents and include a price table completed with all unit prices. The bidder must have in its team a person with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the deadline for submission of tenders; for low-voltage works only, at least low-voltage switching authorisations are sufficient, while in other cases both low-voltage and medium-voltage switching authorisations are required. The team must also include a person designated as responsible for the work operation, entered into the partner portal before the deadline. In addition, the team must include a person responsible for electrical work management with valid A-competence or at least level 6 qualification under the Vocational Education Institutions Act, who has the relevant proof at the time of submission and has been added to the partner portal before the deadline. The signatory and the contact person for contract performance must be provided with names, job titles and contact details; if the right of representation does not arise from the articles of association, a power of attorney must be included. In the case of a joint tender, an authorised representative must be named and a joint power of attorney must be attached. The bidder must also take account of the contracting authority’s payment terms: 14 days for contracts up to EUR 59,999, 35 days for contracts between EUR 60,000 and EUR 249,999, and 45 days for contracts of EUR 250,000 or more; if factoring is used, the payment term is 95 days. The bidder must confirm that the tender complies with the tender documents and indicate whether the tender contains business secrets.
