Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another authorised representative, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; for illegal employment of foreign workers or breach of the conditions for employing a foreign national; for illegal use of child labour or human trafficking; if the bidder has tax debt or social security contribution debt; or if awarding the contract would breach sanctions. The bidder must confirm that no exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register. The bidder must hold a valid community transport operating licence and a certified copy of the operating licence for each bus, if the contracting authority cannot obtain the information from a public register. The bidder must provide the transport organiser’s details, and the transport organiser must meet the requirements of Section 44 of the Public Transport Act. For compliance, the bidder must confirm that the bid complies with the procurement documents, submit a joint bidders’ power of attorney if the bid is joint, and provide the bus list/description in accordance with point 4.2 of the technical specification. The bid price must be submitted in the required structure on the worksheet titled “Award criteria and evaluated indicators”.
