Compliance requirements
The bidder must confirm that neither it nor its management or supervisory body members have been convicted within the last five years of participation in a criminal organisation, corruption, fraud, money laundering, financing of terrorism, use of child labour, human trafficking, or offences related to the commission of a terrorist act or terrorist activity. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. Subcontractor checks apply during contract performance and must not be confused with the bidder’s own exclusion grounds.
Qualification criteria and exclusion grounds
The bidder’s team must include at least one responsible person holding a road engineer qualification, level 6, with the professional field of construction management. If the bidder relies on a specialist from another company, a written confirmation from that company must be submitted stating that the specialist is available, that the company agrees to the use of that specialist, and that the specialist will personally perform the relevant work. If the relied-on person is not an employee of the bidder or the relied-on company at the time of submission, an ESPD must be submitted for that person, and the contracting authority will check that person’s exclusion grounds if the bidder is successful. To prove construction experience, the bidder must have at least two properly performed contracts from the last 60 months covering asphalt works of at least 1,500 m² each, and two contracts covering surface treatment works of at least 2,500 m² each. The bid must comply with the procurement documents, and the price must be submitted according to the required structure and the Appendix 3 pricing table.
