Compliance requirements
The machine-readable notice included the standard exclusion grounds for participation in a criminal organisation, corruption and fraud. For these grounds, the bidder must answer the yes/no questions and, where applicable, provide the requested dates, reasons, persons concerned, exclusion period and self-cleaning information. If an exclusion ground applies, the bidder may submit evidence of measures taken to restore reliability, if allowed by the tender documents or the law. The notice also includes a confirmation that no subcontractor subject to replacement under the relevant law will be used and a confirmation regarding EU sanctions on subcontractors and suppliers.
Qualification criteria and exclusion grounds
The bidder’s average net turnover for the last 3 financial years must be at least EUR 100,000 excluding VAT. During the whole contract period, the bidder must involve a responsible person, i.e. the works manager, who has at least Construction Manager, level 6, or Construction Engineer, level 6, or an equivalent or higher professional qualification. If the bidder uses a foreign professional or competence certificate, a copy of the certificate or other proof of the right to perform the relevant work in the country of establishment must be submitted. The bidder must provide the responsible person’s name and certificate number, and the contracting authority may request additional evidence of that person’s link to the bidder. The bid must comply with the procurement documents; conditional bids are not allowed; and, where relevant, equivalence and supporting evidence must be provided. A guided site visit is mandatory; if the bidder did not attend, the bid will be rejected. The bid must also include the bid price form. In a joint bid, a power of attorney for the joint bidders must be attached. If any information is treated as a trade secret, it must be briefly described and justified. The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the procurement documents.
