Compliance requirements
The bidder must not be subject to any of the exclusion grounds set out in Section 95(1)(1)–(5) of the Public Procurement Act. These include, among other things, convictions for certain crimes, unlawful use of labour, tax debts and breach of sanctions. The bidder must confirm that no exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment if this is required by the laws of that country, and must provide evidence of registration where required. The bidder and/or its subcontractor must have properly performed at least 1 similar contract within the last 60 months before the start of the procurement, covering medium- or high-voltage cable installation or cable route construction works, including cable installation and connection. A list of contracts must be submitted, showing the contract title, short description, performance period and the other contracting party, together with a confirmation that the contracts were performed properly. For the performance of the works, there must be qualified responsible persons, including an engineer in charge of electrical works with at least Class B competence certificate or equivalent or better; copies of documents proving competence must be submitted. A foreign bidder must submit copies of the documents issued under the laws of its country of establishment and a confirmation that, within one month after signing the contract, it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the qualification and competence of the responsible person. If the bidder relies on the resources of another undertaking, the subcontractor must be added to the subcontractors table in the register.
