Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including criminal organisation, corruption, fraud and other grounds set out in the procurement documents. If an exclusion ground applies, the bidder may have to provide evidence of self-cleaning where allowed. The bidder must also confirm that neither the bidder nor any relied-on entity is established in the Russian Federation or Belarus, that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that the bidder does not use prohibited Russian-linked subcontractors, suppliers or relied-on entities above the stated threshold.
Qualification criteria and exclusion grounds
The bidder must meet the qualification and compliance requirements set out in the tender documents. Financially, the bidder’s net turnover for each of the last three completed financial years before the start of the procurement must be at least EUR 600,000. In technical and professional terms, the bidder must have performed at least 1 contract in the last 60 months before publication of the notice, where the contract covered both the construction of a wood-chip or pellet boiler house with at least 2 MW capacity and the direct production and sale of heat energy. The bidder must provide the contract details in the ESPD, including the contracting party, contact details, object and validity period, and the procurement reference number if the contract was awarded through a public procurement procedure. The bidder must also submit Form 2, the list of documents treated as business secrets with justification, Form 3 for the price structure, Form 8 if submitting a joint tender, and the declaration that the tender complies with the tender documents and that equivalence is explained and evidenced where needed. The fixed interest rate in the price table must be between 4% and 8% per year; zero or negative unit prices and cross-subsidisation between unit prices are not allowed. If the machine-readable notice does not contain a precise requirement, it must be checked in the official tender documents.
