Compliance requirements
The bidder must confirm that no exclusion grounds apply. This means, among other things, that the company’s management or authorised representatives must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal use of child labour or human trafficking. The bidder must also not have outstanding state taxes, fees or environmental charges, or tax or social security contribution debts under the law of the country of establishment. Concluding the contract must not breach an international sanction or a sanction imposed by the Government of the Republic of Estonia.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. As compliance requirements, the bidder must submit an unconditional bid, confirm that the bid complies with the tender documents, provide the bid price in the required structure, and, where necessary, add an explanation of equivalence and evidence of equivalence. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that the bidder meets the participation restriction, under which only bidders established in Estonia, another EU Member State, another EEA contracting state, or a country that has acceded to the WTO Government Procurement Agreement may participate.
