Compliance requirements
The contracting authority will exclude a bidder if mandatory exclusion grounds apply, including convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of a foreign national or breach of conditions for employing a foreign national in Estonia, including payment below the statutory wage rate; offences related to illegal use of child labour or human trafficking; or outstanding tax, duty or environmental charge debts, or tax or social security contribution debts under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for serious or persistent breach of a previous public contract, or if the bidder has submitted false information about compliance with qualification requirements or failed to submit requested additional documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of them worth at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties and, for public procurements, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction works were performed properly, unless the contracting authority can obtain the information from public or its own databases without significant cost. In addition, the bidder’s team must include a person responsible for switching operations with valid switching rights for 0.22–20 kV electrical networks, who has been entered into Elektrilevi’s partner portal before the deadline for submitting tenders. The team must also include a person responsible for work operations who has been entered into the partner portal before the deadline. The bidder must also have a person leading electrical works who has a valid A-competence or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, holds the relevant proof at the time of submission, and has been added to the partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must include the completed price quotation table (Form 1) on the prescribed form, with all unit price fields filled in. Conditional bids and bids with additional conditions are not allowed. The bidder must confirm acceptance of all tender document terms, choose the contracting authority’s standard payment term or join the factoring programme, and state any business secret in the bid with justification. The bidder must also confirm that its team includes a person with switching rights and that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
