Compliance requirements

The bidder must not have the exclusion grounds listed in the Estonian Public Procurement Act § 95(1) points 1–5 and § 95(4) point 12. The bidder must confirm the absence of these grounds in the public procurement register. If there are other persons in the company who may represent the bidder, make decisions on its behalf or control it and who are not visible in the commercial register card, the bidder must provide their names and personal identification codes, or confirm that no such persons exist. If the bid is submitted by a foreign company or includes a foreign company, supporting documents proving the absence of the exclusion grounds must be added to the bid as required.

Qualification criteria and exclusion grounds

The bidder must submit data on completed contract(s) using Appendix 3. If required by the contracting authority, a confirmation from the client must be provided showing that the railway construction, reconstruction or repair contract was properly performed; the contracting authority does not accept the handover-acceptance act as such confirmation. If the bidder relies on another company’s resources, the legal representative of that company must provide consent in Appendix 5. If the bidder relies on a contract performed by another company, that company must be listed as a subcontractor and the reliance must be marked in the public procurement register. In the case of a joint bid, Appendix 6 must be submitted if needed, showing the size and nature of each joint bidder’s share. The responsible person must have at least Level 5 professional qualification as a railway track mechanic, or an equivalent qualification. If the qualification was not obtained in Estonia, copies of the documents proving the qualification must be submitted. The responsible person’s details must also be provided.
