Compliance requirements

The exclusion grounds include at least participation in a criminal organisation, corruption and other criminal-conviction-related grounds listed in the ESPD. The bidder or its management body members must not have been finally convicted of such offences within the last five years, where the exclusion ground still applies. If such a ground exists, the bidder may submit evidence of self-cleaning measures, if permitted. Qualification criteria and exclusion grounds

The machine-readable notice and the selected tender documents include the following participation and compliance requirements: the bidder must submit the completed tender form (Annex 2) and English- or Estonian-language informative materials for the offered product so that the contracting authority can verify the product’s characteristics and compliance with the requirements. The bid must comply with all tender documents, and conditional bids are not allowed. If the bidder relies on equivalent solutions, equivalence must be explained and supporting evidence must be attached. The bidder confirms that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder also confirms that subcontractors and suppliers involved in performance will not be Russian citizens, residents or entities established in the Russian Federation, nor entities more than 50% owned by them or acting on their instructions, for more than 10% of the contract value. During performance, the bidder may use only subcontractors and suppliers whose place of residence or establishment is in Estonia, another EU Member State, another EEA Agreement State or a WTO Government Procurement Agreement country. If the bid is a joint bid, a power of attorney from the joint bidders must be attached. The bidder must also identify any authorised persons who are not visible in the business register.
