Compliance requirements
The bidder must confirm the standard exclusion grounds, including that neither the bidder nor its management, administrative or supervisory body members, nor persons authorised to represent or control it, have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud, unless the disqualification period has expired. If an exclusion ground applies, the bidder may describe self-cleaning measures and, where available, provide evidence electronically. The notice also includes the EU sanctions-related restriction: for part 1, the bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian nationals, residents, entities established in the Russian Federation, entities more than 50% owned by such persons or entities, or representatives acting on their instructions.
Qualification criteria and exclusion grounds
The bidder must have completed at least two contracts for the sale of the products in the tender, or equivalent products from the same manufacturer, within the last three years counted back from the publication of the contract notice. A list of the main properly performed sales contracts from the last three years must be submitted, including contract value, dates of conclusion and the other contracting party. The bidder must submit the offer in the required Excel form for Annex 1 with unit prices and the total price for each lot, and all item names within a lot must be offered. The manufacturer’s quality management system for the offered products must be certified according to ISO 9001 or an equivalent standard, and a valid copy of the certificate must be provided. Product safety data sheets, original product cards and product cards translated into Estonian must also be submitted. If an equivalent product is offered, equivalence must be explained and supported by evidence as needed.
