The bidder must not have the exclusion grounds listed in the Estonian Public Procurement Act § 95(1) items 1–5 and § 95(4) item 12. The bidder must confirm the absence of these grounds in the procurement register. If there are other persons in the bidder’s company who may represent the company, make decisions on its behalf or control it, and they are not visible on the commercial register card, the bidder must provide the authorised person’s name and personal identification code, or confirm that no such persons exist. If a foreign company participates in the bid, or if the bid includes a foreign company as a relied-on entity, subcontractor or joint bidder, the bidder must submit the documents proving the absence of the exclusion grounds listed above. If the bid is submitted by a branch of a foreign company, the bidder must also submit the documents proving the absence of those exclusion grounds for the foreign company.

The bidder’s total turnover from all business activities in the last three completed financial years must be at least EUR 900,000. If the bidder relies on the resources of another company, the relevant consent and, where required, supporting evidence must be submitted. In a joint bid, information on the size and nature of each joint bidder’s share of the contract must be provided. The bidder must involve a project manager who has at least Level 6 professional qualification as a construction engineer with specialisation in Building Construction in the occupation of Construction Management or Construction Supervision, or Level 6 professional qualification as a road engineer with specialisation in Roads or Bridges in the occupation of Construction Management or Construction Supervision. If the professional standards become invalid, the person must meet an equivalent new standard. For the project manager, the bidder must provide the name and certificate number, and, if the qualification was not obtained in Estonia, copies of the documents proving the qualification. If the bidder relies on another company’s capabilities, the other company’s consent must be attached and, where necessary, the subcontractor and reliance must be indicated in the register. In a joint bid, the joint bidders’ power of attorney and Annex 5 form must be added where required. The bid must comply with the tender documents, be signed by the bidder’s legal representative or an authorised person, and a power of attorney must be attached where needed. The bid price must be submitted in the required structure and the Bid Price Table must be added. If a product or solution different from the sample product or solution is used, the bidder must provide a justification of equivalence and supporting evidence. The bidder must submit a description and basic scheme of the proposed integrated solution and confirm that the work will be carried out in an environmentally friendly manner, following environmental safety requirements and separate waste collection.
