Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking. If any such ground applies, the bidder may submit evidence of self-cleaning measures where permitted.
The bidder must also confirm that it does not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Estonian Public Procurement Act. In addition, the bidder must confirm that subcontractors and suppliers linked to the Russian Federation within the meaning of Council Regulation (EU) 2022/576 will not account for more than 10% of the contract value. The machine-readable notice did not include precise additional exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s annual net turnover for each of the last three financial years must be at least EUR 300,000. If the bidder has operated for less than three years, turnover is calculated as the average for the period of operation.
Within the last 60 months, the bidder must have performed, as main contractor or as a subcontractor organising and carrying out all construction works, similar works in at least the following scope: fully completed or fully reconstructed ditches under a land improvement system construction project at least 5 km in total, culverts with a diameter of at least 400 mm at least 10 units, and roads of at least 1 km or 5,000 m2. The roads may be roads within the land improvement system service area or public roads, if they are linked to the required works.
The bid must confirm compliance with the tender documents and the price must be submitted according to the structure in Annex 2. In the case of a joint bid, a power of attorney for the joint bidders must be attached. If subcontractors are used, Annex 4 Form 1 must be submitted.
