Compliance requirements
The bidder must confirm that none of the exclusion grounds under subsection 95(1), points 1–5 of the Estonian Public Procurement Act apply. In practical terms, this means no relevant convictions of the bidder or its representatives, no illegal employment-related offences, no child labour or trafficking offences, no tax or social security debt as described, and no breach of international or government sanctions. The bidder must also confirm that it has reviewed the rules and instructions published on the contracting authority’s website.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register in its country of establishment, if required by that country’s law. For bidders established in Estonia, the contracting authority checks the register data itself. A foreign bidder must provide confirmation of registration. In addition, the bidder must confirm that it has an online product catalogue and price list, and must provide the website address and the discount percentage. If proof is required in file form, the relevant evidence must be attached to the tender.
