Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been opened against it, or if its business activity has been suspended. Exclusion also applies if the bidder has outstanding state tax, fee or environmental charge debts, or tax or social security contribution debts, unless they have been deferred or paid. If the absence of such debts cannot be checked in public registers, the contracting authority may request evidence issued no more than two weeks before the tender submission deadline. The bidder is also excluded if any of the grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act apply, if it does not confirm compliance with the required average wage condition, or if it does not prove that condition with a Tax and Customs Board extract. In the case of a joint bid, these grounds apply to all joint bidders. The bidder is also excluded if it fails to submit the required documents within 10 calendar days after receiving the request, or if it is a related person to the technical consultant advising the apartment building reconstruction for the beneficiary.
Qualification criteria and exclusion grounds
The bidder must meet the registration, turnover, experience and team requirements set out in the tender documents.
- For construction works, the bidder must have notified the Economic Activities Register under the activity of construction with the relevant sub-activities: general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have notified the register under the activity of electrical works for the construction, including installation, of an electrical installation. The register entry requirement does not apply to a foreign bidder; in that case equivalent proof of competence must be provided.
- The bidder's net turnover for the financial year preceding submission of the tender must be at least equal to twice the estimated value of the contract, excluding VAT. The exact amount must be entered to the nearest euro.
- Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction contract worth at least half of the estimated value of the contract. Equivalent work means building erection, extension and/or full-building reconstruction as the main contractor, including at least structural and external envelope works, heat-recovery ventilation works, and new heating system works. The bidder must provide the project name, building details, time, value, and information showing that the work met these requirements.
- The bidder's team must include a project manager with at least a level 6 construction engineer qualification or level 6 construction manager qualification; a site manager with at least a level 5 construction foreman qualification; a ventilation and heating systems specialist with at least a level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification; a water supply and sewerage systems specialist with at least a level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification; and, if electrical works are performed, a person with at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations.
- If the bidder relies on the capacities of another person for specialists, the bidder must add that person's signed confirmation of participation in contract performance.
- The bidder must provide the names and certificate numbers of the required specialists.
- The bidder must confirm that the bid follows the structure required on the price sheet and must submit the required bid form. If the bid contains a trade secret, the bidder must identify it and explain why it is treated as a trade secret.
- If the bid is a joint bid, the joint bidders must appoint an authorised representative and provide a joint-bid power of attorney.
