Compliance requirements

The bidder must confirm that neither the bidder nor its management, representation or supervisory persons have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, fraud, or terrorist offences related to terrorist activities. If any exclusion ground applies, the bidder must also provide a description of self-cleaning measures where this is allowed. The bidder must also confirm that it does not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act, and that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.

Qualification criteria and exclusion grounds

The bidder must have an annual net turnover of at least EUR 200,000 in the last financial year ended by the start of the procurement. Joint bidders may combine their figures. The bidder must provide the turnover information in the ESPD and, if requested, the latest annual report extract or other documents proving the turnover. For technical and professional capacity, the bidder must submit a list of major construction contracts completed within the 60 months before the start of the procurement that meet the contracting authority’s specified characteristics, together with evidence that the works were performed properly. If the bidder relies on another entity’s resources, the bidder must also provide that entity’s details and, on request, its consent confirming the permitted turnover reliance, availability of financial resources if needed, and joint liability for the part of the contract covered by those resources.
