Compliance requirements
The bidder must be excluded from the procurement procedure if any of the exclusion grounds under § 95(1) points 1–5 of the Estonian Public Procurement Act apply to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the company. These grounds include participation in a criminal organisation, corruption, fraud, terrorism or its financing, enabling illegal employment, illegal use of child labour or human trafficking, tax debt, and breach of an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these grounds apply to it.
Qualification criteria and exclusion grounds
The bidder and/or its subcontractor must have at least one properly performed contract, completed within the 60 months preceding the start of the procurement, for foundation construction or reconstruction works of similar complexity and scope. A list of at least one such contract must be submitted, including its value, dates and the other contracting parties.
For the person responsible for carrying out the works, the bidder must use a qualified specialist: at least one construction works manager with a professional qualification as a civil engineer at level 6 or higher (initial qualification is not sufficient) with competence in managing construction activities, or a construction manager at level 6 or higher with specialisation in general construction. A copy of the document proving that person's qualification and competence must be submitted.
For the person responsible for design works, the bidder and/or its subcontractor must have at least one designer with a professional qualification as a chartered civil engineer at level 6 or higher (initial qualification is not sufficient) with competence in preparing building design projects or managing design. A copy of the document proving that person's qualification and competence must also be submitted.
