Compliance requirements

The bidder is excluded if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence or other terrorism-related offence, money laundering or terrorist financing. The bidder is also excluded if such persons have been convicted of enabling the employment of a foreign national staying in the country illegally, violating the conditions for employing a foreign national in Estonia, illegal use of child labour, or an act related to human trafficking. Another exclusion ground is tax, duty or environmental charge arrears, or arrears of tax or social security contributions under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract so that the contract was terminated, rescinded, the price was reduced, damages were compensated or a contractual penalty was paid, or that has submitted false information about qualification or failed to submit required data and additional documents. The bidder must confirm that none of these grounds apply to it or its representatives, and must also confirm that it is not established in Russia or Belarus and that the materials, equipment and goods used in the works are not produced in or originating from Russia or Belarus; origin certificates may be requested as proof. Joint bidders must confirm whether the bid is joint and, if so, whether the joint power of attorney has been attached. The bidder must also confirm that it accepts the tender conditions and that no trade secret is being claimed without justification, where applicable, in accordance with the tender documents and the mandatory confirmations required in the notice and documents. Qualification criteria and exclusion grounds

The bidder must have, during the 60 months before the start of the tender, properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties (the client representative’s contact details, including phone number and email address), and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the authority can obtain the information from public or its own databases without significant cost. The bidder must also provide the names, job titles and contact details of the contract signatory and the contact person for contract performance, and if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must include the price table in the required form, with all unit price fields completed. The bidder must have a person with switching rights for 0.22–20 kV electrical network switching operations, who is entered in Elektrilevi’s partner portal before the deadline for submitting bids; for low-voltage works only, at least low-voltage switching rights are required, otherwise both low-voltage and medium-voltage switching rights are required. The bidder must also have a person responsible for the work operation, entered in the partner portal before the deadline. The team must include a person managing electrical works with valid A-competence and/or at least level 6 qualification under the Occupational Qualifications Act, who has the relevant proof at the time of bid submission and is entered in the partner portal before the deadline. Joint bidders must appoint an authorised representative from among themselves and, if the bid is joint, attach the joint bidders’ power of attorney. The bidder must confirm that the bid complies with the tender documents, that no conditional or additional terms are included, and that the bidder will use the contracting authority’s standard payment term unless it joins the factoring programme. The bidder must also state any trade secrets in the bid and justify their designation, or confirm that the bid contains no trade secrets.
