Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or financing of terrorism. Exclusion also applies if such a person has been convicted of enabling the employment of a foreign national staying in the country illegally, of violating the conditions for the employment of a foreign national, of unlawful use of child labour, or of an act related to human trafficking. The bidder must not have tax, fee or environmental charge arrears, nor tax or social security contribution arrears under the law of its country of establishment. The contract will also not be awarded if concluding it would breach an international sanction or a sanction of the Government of the Republic. The bidder must submit a free-form confirmation that no exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must meet the financial, experience and team requirements set out in the tender documents. Specifically, the bidder's average annual turnover for 1 January 2023 to 31 December 2025 must be at least EUR 35,000, and this must be proved with a free-form statement describing compliance together with a balance sheet signed by the bidder's legal representative. The bidder must also show experience from the last three years (1 January 2023 to 31 December 2025) in providing supervision services for construction and/or reconstruction works similar to the contract object. Similar work means site supervision for the construction and/or reconstruction of gravity wastewater or stormwater sewer pipelines. The bidder must provide information on at least two contracts, and within those contracts supervision must have been carried out for the construction of at least 100 m of De400 gravity wastewater or stormwater sewer pipeline. The bidder's team must include a site supervision team leader with at least level 8 authorised water supply and sewerage engineer qualification or an equivalent qualification, a water and sewerage systems supervision specialist with at least level 7 certified water supply and sewerage engineer qualification or an equivalent qualification, and a road construction supervision specialist with at least level 7 certified road engineer qualification or an equivalent qualification. If needed, the team leader and the water and sewerage specialist roles may be combined in one person if one person meets both competence requirements. If the key person's employer participates in the tender as a subcontractor or does not participate in the tender, the bidder must submit the employer's confirmation on Form 1. The bidder must also use the forms attached to the tender documents.
