The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment of a foreign national or violating wage requirements; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears; or breach of sanctions when concluding the contract. The bidder must confirm that none of these grounds apply to it.

The bidder must be registered in the commercial register or another similar register in its country of establishment, if this is required by the laws of that country. For an Estonian bidder, the contracting authority checks the data itself. A foreign bidder that must be registered under the laws of its country of establishment must submit a valid copy of the registration certificate. The bidder and/or its subcontractor must have properly performed at least one contract for repair of metal structures similar to the subject of the procurement within the 60 months before the start of the procurement. The bidder must submit a list of the most important works contracts performed by the bidder and/or its subcontractor during the 60 months before the start of the procurement, including information on their value, dates and the other contracting parties, using the contract list form. The bidder and/or its subcontractor must have a qualified person responsible for the works who will be used for performing the contract, including: a person leading design works with professional qualification as a civil engineer, at least level 6, with competence in design of building structures, or equivalent or better. The bidder and/or its subcontractor must have a qualified person responsible for the works who will be used for performing the contract, including: a person leading construction works with professional qualification as a civil engineer, at least level 6, except initial qualification, with competence in management of construction activities, or a construction manager, at least level 6, or equivalent or better. The bidder and/or its subcontractor must have one welding coordinator with certification meeting EVS-EN ISO 14731:2006 or EVS-EN 1090-2 (Welding Engineer, Welding Technologist or Welding Specialist), or equivalent or better. The bidder and/or its subcontractor must have at least two welders with certification meeting EVS-EN ISO 9606-1, or equivalent or better. The bidder must submit copies of documents proving the qualifications and competence of the responsible persons.
