Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, if its business activity has been suspended, or if it is in a similar situation. Exclusion also applies if the bidder has outstanding state tax, fee or social security contribution debts that have not been deferred or paid within the required time. In addition, none of the exclusion grounds listed in section 95(1) points 1–3 and 5 of the Public Procurement Act may apply, and the bidder and the technical consultant advising the beneficiary on the apartment building reconstruction must not be related persons. If necessary, the bidder must submit evidence that no exclusion grounds apply, including Tax and Customs Board certificates or register-based confirmations.
Qualification criteria and exclusion grounds
The bidder must be registered in the Economic Activities Register for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also be registered for electrical works, including installation of electrical installations. Foreign bidders may prove equivalent competence with an equivalent document.
The bidder's net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value, excluding VAT. The exact amount must be entered in euros.
By submitting the tender, the bidder must be able to provide a first-demand construction-period guarantee issued by a credit institution, financial institution or insurance company in the amount of 5% of the contract value excluding VAT. If the contract is signed before the guarantee is submitted, the guarantee must be provided within 10 calendar days after signing. The guarantee must remain valid for the entire construction period. A deposit of the corresponding amount into the beneficiary's bank account or notary account is also accepted, provided the beneficiary remains the entitled party throughout the construction period. Joint bidders may satisfy this requirement together.
Within the last 60 months before the start of the procurement procedure, the bidder must have completed at least one comparable construction contract with a value of at least half of the estimated contract value. Comparable work means construction of buildings, extension of buildings, or full-scale reconstruction as the main contractor, including at least structural and external envelope works, construction or reconstruction of heat-recovery mechanical ventilation, and construction or reconstruction of a new heating system. The bidder must provide details of the comparable work, including the building, time and value, and proof such as a reference to the building register use notice or use permit number, or a copy of the handover certificate signed by the client and contractor.
For the project team, the bidder must involve qualified persons or persons with equivalent competence: a project manager with at least level 6 construction engineer or construction manager qualification; a site manager with at least level 5 construction foreman qualification; a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification specialised in indoor climate systems; a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification specialised in building water supply and sewerage systems; and, for electrical works, a person with at least a class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. If the bidder relies on the indicators of another person for specialists, the bidder must add signed confirmations from those persons for participation in contract performance.
