Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has been finally convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing, or of illegal use of child labour or trafficking in human beings. Exclusion also applies if the bidder has tax, duty or environmental charge arrears, or arrears of tax or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract, or has submitted false information about compliance with the selection criteria or failed to submit the required information or documents. The bidder must confirm that none of these mandatory or discretionary exclusion grounds apply. The bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information on the other contracting parties (client representative contact details, including telephone and e-mail address) and, in public procurement cases, reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain the information from public or private databases without significant cost. The bidder must also provide the names, job titles and contact details of the contract signatory or signatories and the contact person for matters related to contract performance, and if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must include the price table in the prescribed form, with all unit price fields completed. The bidder must have a person with valid switching rights for switching operations in the 0.22–20 kV electricity network, who is entered in Elektrilevi’s partner portal before the deadline for submitting bids; for low-voltage works only, at least low-voltage switching rights are required, otherwise both low-voltage and medium-voltage switching rights are required. The bidder must also have a person responsible for the work operation, entered in the partner portal before the bid deadline. The bidder’s team must include a person managing electrical works with valid A-competence and/or at least level 6 qualification under the Vocational Education Institutions Act, who has the relevant certificate at the time of bid submission and is entered in the partner portal before the deadline. The bidder must confirm that the bid complies with the tender documents, choose the contracting authority’s standard payment term or join the factoring programme, and state any trade secrets in the bid with justification. The bidder must confirm that its place of establishment or residence is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works, including components, are not produced in or originating from Russia or Belarus.
