Compliance requirements
The bidder must be excluded if the bidder, or a member of its management, administrative or supervisory body, a proxy holder or another person authorised to represent or control the bidder, has a final conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or financing of terrorism. Exclusion also applies if such a person has been convicted for enabling the illegal employment of a foreign national, unlawful use of child labour, or an act related to human trafficking. In addition, the bidder is excluded if it has tax, fee or environmental charge arrears, or social security contribution arrears under the law of its country of establishment. The bidder must confirm that none of these mandatory exclusion grounds apply. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous contract, or that has provided false information on qualification or failed to submit required data and additional documents.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of this contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties (the client representative’s contact details, including phone number and email address), and, in the case of public procurements, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain the information from public or private databases without significant cost. The bidder must also have a person responsible for electrical works with valid A-competence and/or at least level 6 qualification under the Vocational Education Institutions Act, who holds the relevant certificate at the time of submission and is entered in the EPP environment before the opening of tenders.
