Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Estonian Public Procurement Act apply to the bidder or to a member of its management, governing or supervisory body, a procurator or another person authorised to represent or control the bidder: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling work for an alien staying in the country without legal basis or violating wage requirements; illegal use of child labour or trafficking in human beings; tax, fee or environmental charge arrears, or tax arrears in the country of establishment; or breach of an international sanction or a sanction imposed by the Government of Estonia. The bidder must confirm that none of these exclusion grounds apply to it.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or a similar register of its country of establishment, if required by the laws of that country. For this tender, the contracting authority checks the data of bidders registered in Estonia itself. The bidder and/or its subcontractor must have completed at least one contract similar to the subject of the tender within the 60 months before the start of the procurement, with a total value of at least EUR 15,000. The bidder must submit a list of the main contracts completed by the bidder and/or its subcontractor during that period, including the contract name, short description, value, performance period and the other contracting party. The bidder and/or its subcontractor must have qualified responsible persons for carrying out the work, including at least one installation works responsible person with the qualification of security systems technician, level 4 or equivalent. Copies of documents proving the qualification and competence of the responsible person must be submitted. A foreign bidder without Estonian-issued proof must submit copies of equivalent documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Estonian Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person. If the bidder intends to use subcontractors, it must state the scope and nature of the subcontracted part of the contract and provide subcontractor information. If the bidder relies on another undertaking’s resources, including subcontractor reference contracts or responsible specialists, the subcontractor must be entered in the subcontractor table so that exclusion grounds can be checked.
