Compliance requirements

The bidder must confirm the usual exclusion grounds, in particular that neither the bidder nor members of its management bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or other offences listed in the ESPD. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned areas, and that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents or undertakings established in the Russian Federation, or entities controlled by them. The bidder must also confirm that it will not use subcontractors who must be replaced under Section 122(7) of the Public Procurement Act.
