Compliance requirements

Mandatory exclusion grounds are convictions related to participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorist offences or incitement, aiding or attempting such offences, money laundering or terrorist financing; convictions for enabling work for a foreign national staying in the country without legal basis or for violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate; convictions for illegal use of child labour or human trafficking; and tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of the bidder’s country of establishment. Voluntary exclusion grounds are serious or repeated breaches of essential terms of a previous public contract leading to withdrawal from the contract, termination, price reduction, compensation of damage or payment of a contractual penalty, as well as false information about compliance with the selection criteria or failure to submit required additional documents. The bidder must confirm that none of these grounds apply to it.

Qualification criteria and exclusion grounds

The bidder must have, during the 60 months before the start of the tender, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the other contracting parties (including the client representative’s contact details, such as phone number and email address), and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain the information from public or private databases without significant cost. The bidder must also provide the completed price table, a person with valid A-level competence and/or at least level 6 qualification under the Vocational Qualifications Act to lead electrical works and already entered into the EPP environment before bid opening, a person with switching rights for switching operations in the 0.22–20 kV network, a person responsible for the work operation entered into the EPP environment before bid opening, the names, titles and contact details of the signatory(ies) and the contact person for contract performance, and, if representation does not arise from the articles of association, a power of attorney. The bidder must confirm the standard payment term or participation in the contracting authority’s factoring programme, and must state any trade secret information with justification. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works, including components, are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
