Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent, decide for or control the bidder, has been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, a terrorist offence, money laundering or terrorist financing. Exclusion also applies where there has been a conviction for enabling illegal employment or breaching the conditions for employing a foreign national, for illegal use of child labour or an act related to human trafficking, or where the bidder has tax, fee or environmental charge arrears, or arrears of tax or social security contributions. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached a previous public contract, or if it has submitted false information about compliance with the selection criteria or failed to submit the required data and documents. The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties’ contact details (including the client representative’s phone number and email address), and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain the information from public or private databases without significant cost. The bidder must also have a person responsible for switching operations in the 0.22–20 kV electricity network, with valid switching rights, who is entered in Elektrilevi’s partner portal before the opening of tenders. If only low-voltage works (0.22–1 kV) are procured, at least low-voltage switching rights are required; in other cases both low-voltage and medium-voltage switching rights are required. The bidder must have a person responsible for the work operation (C-person) entered in the partner portal before the opening of tenders. The bidder must also have a person managing electrical works with valid A-competence and/or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, who has the relevant proof at the time of submitting the tender and is entered in the partner portal before the opening of tenders. The bidder must submit the names, job titles and contact details of the contract signatory or signatories and the contact person for matters related to contract performance. If the right of representation does not arise from the articles of association, a power of attorney must be included in the tender. The tender must include the price table in the form required by the tender documents, and all unit price fields in that table must be completed.
