Compliance requirements

The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing, child labour or other forms of human trafficking. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that it does not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Public Procurement Act.

Qualification criteria and exclusion grounds

To demonstrate technical and professional capacity, the bidder must submit at least 2 major construction contracts meeting the contracting authority’s requirements, completed within the 60 months preceding the start of the procurement, together with evidence that the works were performed properly. This is a construction works contract, so the contracting authority may also take into account contracts completed more than 60 months ago if needed to ensure sufficient competition. The bid must comply with all tender document requirements, and where equivalence is used, the relevant evidence must be provided. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached.
