Compliance requirements

The bidder must confirm that neither the bidder nor the persons with representation, decision-making or control rights have been convicted for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, facilitating illegal employment of a foreign national, or offences related to child labour or human trafficking. The bidder must also have no tax debt, and the conclusion of the contract must not breach an international sanction or a sanction of the Government of the Republic of Estonia. If a foreign undertaking or foreign related persons are involved, the contracting authority may require documents proving the absence of exclusion grounds.

Qualification criteria and exclusion grounds

The bidder’s total turnover for the last three completed financial years before the start of the procurement procedure must be at least EUR 600,000 excluding VAT, with at least EUR 200,000 in each year. Joint bidders may rely on each other’s figures. If the bidder is foreign or the data cannot be verified from public sources, the contracting authority may request extracts from annual reports or other evidence. Within the 36 months before the start of the procedure, the bidder must have properly performed at least one contract for the design of a 110 kV overhead line, with a value of at least EUR 50,000 excluding VAT per contract. The contract may have started earlier than 36 months before the start of the procedure, but it must have been properly performed during the required period. The contracting authority may request a client reference or other evidence for the reference contract. When submitting the tender, the bidder must provide a duly completed price table and team CV. If the tenderer is not the legal representative, a power of attorney must be submitted. In the case of a joint tender, a joint bidders’ power of attorney and confirmation must be submitted. If the bidder relies on the capacities of another undertaking, a written confirmation from that undertaking with the required content must also be provided.
