Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including criminal organisation, corruption and other standard conviction-based grounds. If an exclusion ground applies, the bidder may provide evidence of self-cleaning measures where allowed. The machine-readable notice did not include the full list of exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in a professional or commercial register, hold the required authorisation or belong to the relevant organisation if this is required by the law of the bidder’s country of establishment for performing the contract. If applicable, a certificate of registration, authorisation or membership must be provided, or a link to a public database must be given.
The bidder’s average annual turnover must be at least EUR 100,000,000 in each of the last 3 financial years before the start of the procurement. The turnover must come from the design, manufacture, supply, delivery and maintenance of railway rolling stock and its components. If income was earned in another currency, it must be converted using the European Commission’s InforEuro exchange rate. To prove compliance, the bidder must submit a breakdown of turnover by year and, where needed, the exchange rate used. This information may be provided in the ESPD or in the qualification form.
For the supply contract, technical and professional capacity is assessed through previous contracts performed during the 36 months before the start of the procurement, concerning the sale of goods or provision of services matching the contracting authority’s specified characteristics. Public authorities may take older contracts into account where permitted.
The tender must include the price and additional points form, the joint tenderers’ form for joint tenders, the reliance-on-another-operator’s-resources form where applicable, the key experts’ CV form and the technical documents listed in the tender documents. The key experts’ CVs must show compliance with the requirements in Annex 6 and include a declaration of no conflict of interest.
The bidder must also submit the list of maintenance spare parts with purchase prices, the special equipment set with purchase prices, and the sanctions and national security confirmations. The bidder must confirm that the offered rolling stock is not subject to international sanctions, does not originate from sanctioned territories and does not pose a threat to the national security of Estonia, Latvia or Lithuania. The bidder must also confirm that the rolling stock and all its components are free from any sanctions-related legal, technical or supply-chain dependency that would make performance unlawful. If requested by the contracting authority, the bidder must provide all documents and data needed for the check.
Under the award methodology, the tender must also include the general layout, traction system drawing, entrance door scheme, cross-sections, front view and seat layout plans. If the bidder wants points for additional seats, body material, number of axles, maintenance interval or maintenance workload, the relevant data must be visible in the required documents or forms. A maintenance interval below 20,000 km makes the tender non-compliant.
