Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, nor persons with representation powers, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not include the precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must hold a licence, registration or membership in a relevant organisation if required by the law of its country of establishment for the activities to be performed under the contract. Financially, the bidder’s average annual turnover for the last 3 financial years before the start of the procurement must have been at least EUR 100,000,000 from the design, production, supply, delivery and maintenance of rail rolling stock and its components. To prove this, the bidder must provide a breakdown of turnover by year and, where needed, the InforEuro exchange rate used. For technical capacity, the bidder must have completed or be performing at least 1 passenger multiple-unit contract in the last 5 years that meets all of the following: 1,435 mm gauge, electric multiple units (EMU), maximum speed of at least 200 km/h, contract value of at least EUR 50 million, compliance with Directive (EU) 2016/797, compliance with ERTMS, and use or planned use in a regular passenger service in an EU Member State, EEA country, Switzerland or the United Kingdom. To prove this, the bidder must submit a list of references with the operators’ names, delivery year(s), quantity and price of the reference rolling stock, and the main technical data. The bid must also include the required forms and documents: Annex 8 cost and additional points form, Annex 4 joint tenderers’ form if applicable, Annex 5 form for reliance on another operator’s resources if applicable, Annex 7 key experts’ CV form, the list and purchase price of post-maintenance spare parts, the set and purchase price of special equipment, the technical documents, and the sanctions and national security confirmations. For the maintenance interval criterion, the proposed interval must be at least 20,000 km; anything below that makes the bid non-compliant. The machine-readable notice did not set out all qualification and compliance requirements in full; the remaining requirements must be checked in the tender documents.
