Compliance requirements

The bidder must confirm that neither the bidder nor the members of its management, representation or supervisory bodies have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The bidder must also confirm that subcontractors and suppliers engaged in contract performance meet the required location and sanctions restrictions, and that persons or entities linked to the Russian Federation are not engaged for more than 10% of the contract value. The bidder must confirm that the bid complies with the procurement documents and, where necessary, provide details of company representatives who are authorised to represent the company and are not visible in the business register. If texts for the awareness activities need to be drafted, understood or translated into Ukrainian and/or Russian, the bidder must have the relevant language capability or high-quality translation capability.
