Compliance requirements
The contracting authority will exclude a candidate and will not sign the contract if the candidate, or a member of its administrative, management or supervisory body, or another legal or contractual representative connected with the procurement, has the exclusion grounds referred to in the Public Procurement Act. The notice also says that candidates established outside Estonia must submit separate evidence that these exclusion grounds do not apply. The machine-readable notice does not give a more precise list beyond the legal references, so the exact grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
For the low-voltage works, the bidder must either have, or involve a candidate, joint bidder or subcontractor that has a state-secret processing permit issued by the Estonian Internal Security Service at the level SECRET or higher and an information-systems accreditation compliance certificate issued by the Foreign Intelligence Service at the level SECRET or higher. The permit and certificate must remain valid for the entire contract period; if they expire during the procedure or the contract term, a new application must be submitted in time so that access does not lapse. A foreign bidder may meet this requirement with an equivalent permit from its country of establishment if there is a mutual protection agreement on classified information between that country and Estonia.
The performance team must include at least the following responsible persons: a chief project manager, a design manager, two site managers for construction works, a person responsible for the design of low-voltage works, and a person responsible for low-voltage works. The chief project manager must be at least a Chartered Civil Engineer, level 7, or a Licensed Civil Engineer, level 8, with specialisation in building construction and competence in construction management, or equivalent, and must hold a personal security clearance for classified information at least at the CONFIDENTIAL level at the time of submitting the application. The design manager must be at least a Chartered Civil Engineer, level 7, or a Licensed Civil Engineer, level 8, with specialisation in building construction and competence in design management, or equivalent. There must be two site managers, each at least a Civil Engineer, level 6 or higher, with competence in construction management or equivalent. The person responsible for designing low-voltage works must be at least a Security Systems Designer, level 6, with the required selectable competencies, and must have a state-secret access permit at the level SECRET or higher by the time the contract is signed. The person responsible for low-voltage works must hold a valid Security Systems Responsible Specialist certificate, level 5, with at least one required competency and also a state-secret access permit at the level SECRET or higher.
The bidder must prove that, during the 60 months preceding the start of the procurement, it has properly carried out similar design and construction works as the main contractor. Similar works mean the design and construction of at least one insulated building with stable indoor climate and premises used for education, office or storage, with a closed net floor area of at least 3,000 m2. Proof must include the client’s confirmation that the works were performed in the required scope and properly. If the bidder relies on another undertaking’s resources, it must also submit that undertaking’s written and signed consent and any other required evidence. The details of the responsible persons must be submitted on the required form.
