Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD under Estonian Public Procurement Act section 95. The bidder or members of its representative, management or supervisory bodies must not have been finally convicted of these offences within the last five years, or the disqualification period stated in the judgment must still apply. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is allowed. Evidence of payment of taxes and social security contributions must be provided, or an electronic access option must be available, if required. The contracting authority may reject a bid if it does not meet the sanctions requirements or if the bidder engages prohibited Russia-linked subcontractors or suppliers for more than 10% of the contract value.
Qualification criteria and exclusion grounds
The bidder must complete the ESPD and provide the required declarations and evidence. The ESPD must confirm that the bidder is not subject to the listed exclusion grounds and, where relevant, provide details of convictions, self-cleaning measures and electronically available evidence. According to the compliance requirements, the bid must comply with all tender document requirements, be unconditional, and include the completed participation application, the price form and the technical description. The bid must include technical documentation for the device and all accessories, the manufacturer’s documents, a list of components, the frequency and content of routine maintenance, and the list and prices of maintenance consumables and spare parts. The team must include at least one medical technology specialist, and the bidder must provide that person’s details and the manufacturer’s confirmation of completed training. In the case of a joint bid, a power of attorney from the joint bidders must be attached. Equivalence must also be confirmed where the offered solution is not exactly as described in the tender documents.
