Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, insolvency or liquidation proceedings have been opened against it, or its business activity has been suspended. Exclusion also applies if the bidder has outstanding state tax, fee or environmental charge debts, or tax or social security contribution debts, unless they have been deferred or paid within the required time limit. In addition, the grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act must not apply, and the bidder must not be a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. In a joint tender, these requirements apply to all joint bidders. The machine-readable notice did not fully set out the precise exclusion grounds; if needed, they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered under the construction activity area for general building works, indoor climate systems, and building-internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction and installation of electrical installations. A foreign bidder is not subject to the Estonian register registration requirement, but must provide an equivalent proof of competence where applicable. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the expected contract value excluding VAT. The bidder must be able to provide a 5% construction-period guarantee by the time the contract is signed, or within 10 calendar days after signature. The bidder must have completed at least one comparable construction project within the last 60 months, with a value of at least half of the expected contract value; comparable work means construction of a building, extension, or full-building reconstruction as the main contractor, including load-bearing structures and external envelope works, heat-recovery ventilation, and heating system construction or reconstruction. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence. The project manager must have at least a Level 6 civil engineering qualification or a Level 6 construction manager qualification; the site manager must have a Level 5 construction foreman qualification; the ventilation and heating systems specialist must have at least a Level 6 heating, ventilation and cooling engineer qualification or a Level 6 construction manager qualification; the water supply and sewerage systems specialist must have at least a Level 6 water supply and sewerage engineer qualification or a Level 6 construction manager qualification; and the electrical works performer must have at least a Class B competence certificate or a Level 6 electrical engineer qualification in consumer electrical installations. If the bidder relies on the capacities of other persons, signed commitments from those persons to participate in contract performance must be included.
