Compliance requirements
The bidder is excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or otherwise suspended in a similar situation under the law of its country of establishment. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after receiving notice of the exclusion ground. The notice also requires confirmations that the bidder has no exclusion grounds under the relevant public procurement law provisions, that the average wage of its employees was not below 70% of the average wage in the relevant sector during the reference period, and that the bidder is not a related person to the technical consultant advising the contracting party on the apartment building reconstruction. If the contracting authority cannot verify the absence of these grounds from public registers, the bidder may be asked to submit supporting evidence issued no more than two weeks before the tender deadline.
Qualification criteria and exclusion grounds
The bidder must have filed a notice in the business register under the construction activity category covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a notice for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but the bidder must provide equivalent proof of competence if needed.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be stated to the nearest 1 euro.
The bidder must confirm that, by the date of signing the construction contract, it can provide a first-demand guarantee letter issued by a credit institution, financial institution or insurance company in the amount of 5% of the construction contract value excluding VAT. The guarantee must remain valid for the entire construction period; depositing the corresponding amount into the contracting authority’s bank account or a notary account is also accepted. Joint bidders may satisfy this requirement together.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means the construction, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing structure and external envelope, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a new heating system. To prove this, the bidder must provide the number of the occupancy notice or occupancy permit in the building register, or a copy of the handover-acceptance certificate signed by the client and the contractor.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence. The required qualifications are: for the project manager, an engineering or construction manager qualification; for the site manager, a construction foreman qualification; for the ventilation and heating systems specialist, a heating, ventilation and cooling engineer or construction manager qualification; for the water supply and sewerage systems specialist, a water supply and sewerage engineer or construction manager qualification; and for electrical works, a B-class competence certificate or an electrical engineer qualification in consumer electrical installations. If the bidder relies on the capacities of other persons, signed confirmations from those persons allowing participation in contract performance must be attached.
