Compliance requirements
The machine-readable notice states the mandatory exclusion grounds in plain terms: the bidder is excluded if it is bankrupt, in liquidation, under bankruptcy or liquidation proceedings, or if its business is suspended or it is in a similar situation under the law of its country of establishment. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred, paid, or will be paid/deferred within 10 calendar days after receiving notice of the exclusion ground. The notice also refers to the general exclusion grounds under the Public Procurement Act and to the requirement that the bidder must not be a related party to the technical consultant advising the contracting authority on the apartment building reconstruction. If the public registers cannot be checked, the bidder may be asked to submit evidence issued no more than two weeks before the tender deadline.
Qualification criteria and exclusion grounds
The bidder must be registered under the construction activity category with the relevant sub-activities for general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but in that case equivalent proof of competence must be provided.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be stated to the nearest 1 euro.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means the construction of a building, an extension, or a full-building reconstruction as the main contractor, and it must include at least the construction or reconstruction of the load-bearing structure and external envelope, the construction or reconstruction of a heat-recovery mechanical ventilation system, or the construction or reconstruction of a new heating system. For proof, the bidder must provide the project name, building details, period of performance, value, and information on which of the listed works were included.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, where electrical works are performed, a competent person. The project manager must have at least a level 6 construction engineer qualification or a level 6 construction manager qualification; the site manager at least a level 5 construction foreman qualification; the ventilation and heating systems specialist at least a level 6 heating, ventilation and cooling engineer qualification or a level 6 construction manager qualification with the relevant specialisation; the water supply and sewerage systems specialist at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with the relevant specialisation; and for electrical works at least a B-class competence certificate or a level 6 electrical engineer qualification for consumer electrical installations. If the bidder relies on the capacities of other persons, signed confirmations from those persons allowing them to participate in contract performance must be attached.
The bidder must also be able to provide a construction-period security: a first-demand guarantee letter from a credit or financial institution or an insurance company in the amount of 5% of the construction contract value excluding VAT, by the contract signing date at the latest or within 10 calendar days after signing. The security may also be provided by depositing the corresponding amount.
